Being accused of a crime is not a pleasant experience. In fact, it can be down right scary and intimidating. By definition, all criminal cases carry at least the possibility of punishment by jail or prison time. Some crimes carry a “minimum mandatory” jail or prison sentence. Most people are unaware of their options and have numerous questions.
Criminal law is all about the elements of the crime. Know the elements for each common law crime, know the subtle lines (like blackening vs. charring for arson, etc.) and then apply the facts for each element. At the end, sum up whether all elements have been met, or which ones were not satisfied.
Criminals don’t obey the laws to begin with. Why would adding more laws that restrict the honest, law abiding citizens make a difference? Criminals usually get their guns illegally already.
