Video Deposition of the Supervisor Who Ordered the False Arrest of Demetrius Kern (update Part 2)

This is Part 2 of the update on the viral video arrest of Demetrius Kern from Cleveland Heights, Ohio, which I originally covered in July of 2023, along with Mr. Kern’s attorney, Chris Wiest. Mr. Kern had been falsely arrested and charged after he was almost hit by a police cruiser driven by Officer Carly Lewis, whose video deposition was featured in Part 1 of this update. That arrest was primarily at the direction of Officer Lewis’ supervisor, Sgt. Naftali Wolf, whose video deposition is detailed in this video.

As I mentioned in the video, as of this date, the Court has not yet ruled on the pending motions. Which means that the case is just hanging in limbo with nothing happening, until such time as there is a ruling. The ruling will decide whether or not the lawsuit gets dismissed, or whether it proceeds to a jury trial. This is fairly unusual for a delay of this length to occur in federal court – though sometimes does happen).

Remember the video I did back in July of 2023, with attorney Chris Wiest, about the lawsuit that he had just filed for a guy named Demetrius Kerns? Kerns was almost hit by a police officer who was driving recklessly. Then when he stopped to get her information afterwards, and she apologized to him, her supervisor then showed up and began to escalate the situation, demanding Mr. Kerns’ ID and ultimately putting him in handcuffs – and later falsely charging him with obstruction, in retaliation for the fact that he was filming and being critical of the police. As Chris and I discussed, eventually he would have the opportunity to take the depositions of these two officers.

Well, it’s been a couple of years now and I have an update for you. The case isn’t over yet. It’s still pending. These things can take years. But I actually have the full video depositions of these two officers, and I’m going to go through them with you so that you can hear exactly what they had to say when confronted under oath. First, part 1 – the sworn testimony of Officer Carly Lewis. And then in Part 2 we’ll get to the rather-unbelievable video testimony of her supervisor, Sergeant Naftali Wolf.

BREAKING: Lawsuit Settled | Cop Fired and CHARGED | His Lawyer Explains

One of the excessive force cases we’ve been following just settled, and you may or may not be surprised at the settlement amount. This is the one in Kentucky where a man was arrested inside his parents’ home and was beaten – not terribly – but still beaten, by two Kentucky State Troopers. Then the dad goes to get his cell phone and starts filming. The troopers then took the phone and deleted the footage. Well, as sometimes happens, the parents had interior surveillance cameras that the cops did not know about. My buddy Chris Wiest files a lawsuit against them; puts them under oath at their depositions, and asks them about it. Both troopers denied striking the guy. Unfortunately for them, they had been caught on camera. 

On April 9, 2020, Kentucky State Troopers James Cameron Wright, Thomas Czartorski, and a third trooper, Kevin Dreisbach, went to the Hornbacks’ home in Shepherdsville, Kentucky, to arrest 29-year-old Alex Hornback for a missed appearance in Jefferson District Court. Hornback’s mother and father met them at the door and led Wright and Czartorski to the basement, where their son was, while Dreisbach covered the rear of the house.

Czartorski and Wright testified in their January 2021 depositions that they had a relatively calm interaction with Hornback, despite taking him to the floor, and that they didn’t use any other force or strike him.The Hornbacks’ lawyer later released a home-security video contradicting the troopers’ statements. The video showed Wright grabbing Hornback around the neck and slinging him to the floor, though Hornback was not visibly resisting. The video also showed Czartorski striking Hornback four times on the legs with his flashlight. Wright hit Hornback twice in the back with his right forearm and appeared to have his left knee on Hornback’s neck, pushing his face into the floor. Hornback did not suffer any serious injuries.

“Creepy Search Cops” Ask Federal Court to Restrict My YouTube Channel

I know that many people are following my progress in the Creepy Cops Search Case out of Putnam County, West Virginia, where drug task force police officers were caught on camera illegally searching my client’s house. That apparently includes those officers and their lawyers in the pending federal civil rights lawsuit. This is the most recent update about the case:

On Friday, the defendant officers’ lawyers filed a motion completely centered on my Youtube channel, requesting an order prohibiting me from ever publishing video deposition testimony of those police officers. Basically they’re requesting court approval for a coverup. Now, important First Amendment issues are implicated. Police already have qualified immunity. The one remedy given to us by Congress it to sue them. Now they want to turn that process into something akin to Family Court or abuse and neglect proceedings, where government gets to operate in secrecy and without accountability and exposure. Here’s the motion they filed:

The video depositions in the Creepy Cops Search Case haven’t even been taken yet. They’re actually scheduled to be taken in a few days. I already agreed to postpone them several times already at their request, because they were concerned that the FBI was investigating them. So I gave them time to evaluate their situation and hire or consult criminal defense attorneys before they testified. Now, they want to testify essentially in secret. Why? Because posting their video testimony allegedly puts them in danger. They went through the prior videos I published on this situation and cherry picked the craziest ones they could find, and presented them to the Court as the basis for why I should be forever silenced from exposing their misconduct. 

At the end of every video I tell you that freedom is scary. Why? Why is it scary? Fear is the tool that tyrants use to subject us and take away our freedoms. Over and over again. From the beginning of recorded history to the present. Of course police officers in America, if given the choice, would choose to operate in secrecy. They don’t want to be recorded. They don’t want to give you their names – they just want yours.
